Terms of Service

Last updated: April 2025

1. Acceptance

By creating a Patchly account or using the Patchly SDK, API, or dashboard, you agree to these Terms of Service ("Terms"). If you are using Patchly on behalf of an organisation, you represent that you have authority to bind that organisation.

2. The service

Patchly provides error monitoring, grouping, GitHub-issue creation, and AI-assisted repair notes for software projects ("Service"). We may add, modify, or remove features with reasonable notice.

3. Acceptable use

You may not:

  • Use Patchly to monitor systems you do not own or have explicit authorisation to monitor
  • Send event data that contains payment card numbers, government IDs, or unencrypted passwords
  • Resell access to the Service without a written reseller agreement
  • Attempt to reverse-engineer, scrape, or overload the ingest or API endpoints
  • Use the Service for any unlawful purpose

4. Payment and plans

Paid plans are billed monthly via Stripe. Prices are listed on the pricing page. We may change prices with 30 days' notice; continued use after the notice period constitutes acceptance.

Event capture pauses when your monthly cap is reached and resumes the following billing cycle. We do not charge overages by default — upgrade your plan for a higher cap.

Refunds are not provided for partial months, but if you cancel within 7 days of a charge and have not consumed the plan's included events, contact us and we will consider a refund on a case-by-case basis.

5. Your data

You retain all rights to the error data and source code you send to Patchly. We process it on your behalf to provide the Service. See the Privacy Policy for data handling details.

6. Uptime and SLA

We target 99.5% monthly uptime for the ingest endpoint. We do not offer SLA credits on the Free or Pro plans. Team plan SLA terms are available on request. Current status is available at patchly.cc/status.

7. Termination

You may cancel your account at any time from the dashboard. We may suspend or terminate accounts that violate these Terms, with or without notice.

On termination we will retain your data for 30 days in case you change your mind, then delete it. You can request immediate deletion by emailing hello@patchly.cc.

8. Disclaimer and limitation of liability

The Service is provided "as is." We make no warranty that it will be uninterrupted, error-free, or that AI-generated repair notes will be correct or applicable to your situation. You are responsible for reviewing any suggested patches before applying them.

To the maximum extent permitted by law, our total liability for claims arising from these Terms is limited to the fees you paid in the 3 months preceding the claim.

9. Governing law

These Terms are governed by the laws of the jurisdiction where Patchly is incorporated. Disputes will be resolved by binding arbitration or in the courts of that jurisdiction.
